Terms of service
These terms govern use of the Failclosed API.
1. Who you are contracting with
The operator is Nytto Labs, a Swedish sole trader operated by Fredrik Kornelind. Registered for VAT in Sweden and approved for F-tax (FA-skatt).
- Product support — support@nyttolabs.com
- Billing and refunds — billing@nyttolabs.com
- Privacy and GDPR — privacy@nyttolabs.com
- Anything else — hello@nyttolabs.com
2. What the service does
Failclosed reads from endpoints you nominate, compares the records they return according to rules you configure, records where they disagree, and — where you have configured it to and the safety limits permit — sends a request you have defined to one of your systems.
We are a conduit. We do not know whether either of your systems is correct, only whether they agree with each other. We do not know whether a correction you configured is the right fix. A run that finds nothing means the two sources agreed, not that anything is true.
3. Automatic repair, and what limits it
Repairs happen only where you attach a repair action and name the divergence kinds it may be used for. Every repair is additionally subject to the refusal rules published at /api/v1/rules, some of which you may configure and some of which you may not. The rules marked non-configurable cannot be switched off on any check, at any price.
These rules are safeguards, not guarantees about your data. They reduce the chance of acting on broken evidence; they cannot tell whether the repair you configured is the right one. You remain responsible for the repair requests you define, for the limits you set including if you set them wide, and for everything a repair does once delivered.
Where a check enables destructive repairs, you accept that a delivered deletion cannot be undone by this service.
4. Price and payment
- 1 thousandth of a cent per record compared.
- €0.05 per repair that reached its target.
- A repair we refused to send is free.
- A run that could not read a source is not charged for.
- Credit is prepaid from €25.00, one credit to one cent, and does not expire.
There is no subscription, no seat fee and no minimum spend. Payments are processed by Stripe and we never receive your card details.
The seller is a Swedish sole trader, registered for VAT in Sweden and approved for F-tax (FA-skatt). Prices are as shown. VAT is accounted for as Swedish law requires; it is not added automatically at checkout, and the reverse charge is not applied at checkout.
If you enable automatic top-up, you authorise us to charge your saved payment method the amount you configured whenever your balance falls below your threshold. You may switch it off at any time through the API, and we stop attempting it after three consecutive failures.
When your balance runs out, checks stop running. Nothing is performed on credit.
5. Your responsibilities
You may register only endpoints you are authorised to read from and write to, and you must hold the rights to any credential you supply. You are responsible for everything your checks do, including every correction fired within the limits you configured.
You must not use the service to:
- read from or write to systems you are not authorised to access;
- poll a third party in breach of its terms or rate limits, or use us to disguise the origin of requests in order to evade them;
- harvest data from a source you do not have the right to extract from;
- attempt to reach private, internal or metadata addresses.
Only public https endpoints are reachable and we enforce this technically, but the obligation is yours regardless. We may suspend an account that appears to be breaching this section.
6. Credentials you store with us
Secret header values you register are used solely to make the requests you have defined. They are never returned by the API and never written into a run, divergence or correction record. Deleting a source or an action deletes them.
7. Availability and liability
We aim to keep the service available but do not guarantee uninterrupted operation, and a missed run is a missed observation rather than a breach. Our liability arising out of any single run or correction is limited to the fee charged for it, and our aggregate liability is limited to the amounts you paid us in the preceding twelve months, except where liability cannot be limited by law. Nothing here affects the mandatory rights of consumers under EU law.
8. Termination and refunds of unused credit
You may stop at any time by pausing or deleting your checks. Unused credit is refundable — see Refunds. We may terminate for breach of section 5, in which case unused credit is refunded unless the breach was fraudulent.
9. Changes and governing law
Changed terms apply to use after the change. These terms are governed by the law of the seller’s place of establishment, without affecting mandatory consumer protection in your country of residence.
